Terms of Service

Draft for counsel review — not legal advice. By creating an account or using the Front End engine, you agree to these Terms, the Acceptable Use Policy, the Engine Access License, and the Agent Integrity Policy.

1. What you are licensing (plain English)

You are not purchasing a downloadable design system or component IP library. You are purchasing authorized use of the Front End engine under these terms.

2. Engine Access License (grant)

Subject to an active subscription (or Free tier limits) and compliance with these terms, Operator grants Customer a limited, non-exclusive, non-transferable, revocable license to:

1. Use the access key issued to Customer's organization to authenticate to api.thefrontend.ai and mcp.thefrontend.ai.
2. Invoke engine capabilities (MCP tools and API endpoints) solely for Customer's internal product design and development workflows.
3. Use the Hub and optional Canvas for account management and visual design surfaces tied to Customer's projects.
4. Run the @thefrontend/connect CLI solely to register MCP and initialize Customer-owned project files as documented.

No other rights are granted. All rights not expressly granted are reserved by Operator.

3. Restrictions (all tiers)

Customer shall not, and shall not permit any employee, contractor, agent, or AI system under Customer's control to:

3.1 Reverse engineering & copying

• Reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or trade secrets of the Front End engine, MCP server, or hosted APIs.
• Scrape, bulk download, mirror, or systematically extract engine responses, tool schemas, prompts, or server rules for reuse outside authorized MCP calls.
• Reimplement or replicate engine operations locally (including promote/capture, re-grounding, cross-project meta-model, or platform export validators) to substitute for or avoid Front End subscription fees.
• Copy or redistribute Operator's client installers, Hub UI, or Canvas application code except as explicitly allowed.

3.2 Circumvention & abuse

• Share, sell, publish, or sublicense the organization access key except as allowed on Team tier via official seat invites.
• Circumvent entitlement checks, rate limits, tier limits, or authentication.
• Use Front End to attack, probe, or disrupt Operator infrastructure.
• Use one Free-tier org to operate multiple commercial products in violation of tier limits.

3.3 Agent & automation responsibility

• Customer is responsible for AI agents (Claude Code, Cursor, custom bots) operating in Customer repos: agents must not bypass the engine per the Agent Integrity Policy.
• Customer will not configure agents to ignore Front End policy files or instruct them to reimplement proprietary engine behavior.

3.4 Resale & redistribution

• No resale, white-label, or redistribution of the Front End engine, MCP endpoint, or "Front End connectivity" as a standalone product or service to third parties.
• Customer may build and ship their own applications using their code and manifest; Customer may not package Front End engine access into a product sold to others without a written partner agreement.

4. Non-compete (competitive use)

During the term of Customer's account and for twelve (12) months after termination for cause related to breach of §3, Customer shall not, directly or indirectly:

1. Develop, market, or distribute a product or hosted service whose primary purpose is substantially the same as the Front End engine (bidirectional design-system governance for AI-assisted front-end development), where such product is built using unauthorized access, reverse engineering, or misappropriation of Front End trade secrets.
2. Assist a direct competitor of Operator in obtaining unauthorized access to Front End or in reverse engineering the engine.

Scope note: This does not prohibit Customer from building normal websites, apps, design tools, or AI products in general. It prohibits using Front End access to clone or replace the Front End engine as a competing service.

5. Intellectual property

Customer grants Operator a limited license to process manifest snapshots synced to Hub (Team tier, backup, engine operations) solely to provide the service.

6. Confidentiality & trade secrets

Engine behavior, unreleased features, internal documentation marked confidential, and non-public API details are Operator trade secrets. Customer will not disclose them except as needed for authorized use, will notify Operator promptly of any suspected unauthorized access or key leak, and will cooperate in protecting Operator IP.

7. Team & agency partners

On Team tier or a signed Agency Partner agreement, Customer may invite seat holders via Hub; each must comply with these terms. Customer is liable for seat holders' and sublicensees' compliance. Agency partners may deploy Front End for client projects only within Hub project boundaries and partner contract.

8. Termination & effect

• Customer cancel: Engine access ends at period end; Customer retains code/manifest.
• Operator terminate for breach: Immediate suspension of key; §4 survival applies where stated.
• Post-termination: Customer removes MCP registration; must not use cached engine logic to operate a substitute service.

9. Disclaimer & limitation of liability

Service provided "as is" to the extent permitted by law. Operator is not liable for indirect or consequential damages. Aggregate liability is capped at fees paid in the twelve months preceding the claim. (Standard SaaS boilerplate — counsel to finalize.)
